1. Use of the QUANACE websites

The QUANACE websites are provided to you free of charge for your personal use, subject to these Terms and Conditions and our Privacy Policy. Using the QUANACE websites, you agree to be bound by these Terms and Conditions and our Privacy Policy.

The QUANACE websites are made up of several services, including the sale of skincare products, literature, merchandise, and salon treatments. These Terms and Conditions govern your use of the QUANACE websites and the products and all services provided in connection with these and across all online platforms.

All orders and purchases made on the QUANACE websites and offline will also be governed by the specific Product Terms and Descriptions relevant to each product and service.

2. Salon Services

We charge a cancellation fee for appointments (excluding Covid 19 reasons) cancelled less than 48hrs before the scheduled appointments. The fee is 50% of the service fee. We are an independent business and cancellations result in a distinguishable loss to our service. The Terms and Conditions in this document continue to apply.

We strive to ensure a Covid secure salon environment at all times. We advise those with symptoms not to book or to cancel their appointment. There will be no cancellation charge in these circumstances. We shall not be held liable and shall not pay any form of compensation if you contract Covid 19, any variant, or receive a positive test result after visiting our premises. 

Our telephone/teleport skin consultation service offers general skincare information, for personal and educational interest only and shall not in any way be relied upon as medical advice.

3. Business Information Bundle

The QUANACE Business Information Bundle provides general business information only and not commercial business or legal advice and shall not be held responsible for any inaccuracies and for goods and services provided by third parties. The QUANACE website shall not be responsible for problems linking to third party websites or third party links contained in the Business Information Bundle that have been subject to change.

By using our telephone service you agree to be bound by the terms and conditions in which this forms part. QUANACE telephone consultation service provides general business information only and not business/legal advice and shall not be responsible for information conveyed during a telephone consultation.

4. Media Kit

Access to our Media Kit shall be granted to media outlets of our choice, subject to these terms and conditions. You agree to the provision that the information contained in the Media Kit shall be used only to publicise the QUANACE Skincare brand and shall not be used for any other purpose. QUANACE requires sight of any material taken from the Media Kit (including interviews/articles) in advance of being presented to the general public. 

5. Testimonial Disclaimed

Testimonials may be provided across online platforms. Each testimonial is based on the personal experience of the individual user and does not represent the opinion of other users

6. Amendments

We may update these Terms and Conditions from time to time without notification. If you do not wish to accept the new Terms and Conditions, you should not continue to use the QUANACE websites. If you continue to use the QUANACE websites after the date the change comes into effect, your use of the QUANACE website indicates your agreement to be bound by the new Terms and Conditions.

7. Excluded Services

The services provided by the QUANACE websites do not include the provision of computers or other necessary equipment to access the QUANACE websites. To use the QUANACE websites, you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.

8. Intellectual Property

The content of the QUANACE websites is protected by copyright, trademark, database and other intellectual property rights. You may retrieve and display the content of the QUANACE websites on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy (including these terms and conditions) or distribute or use any of the materials or content on the QUANACE websites for commercial purposes without written permission from QUANACE.

No licence is granted to you in these Terms and Conditions to use any trademark of the QUANACE websites or its affiliated businesses.

9. Limitations

You may not use the QUANACE websites for any of the following purposes:

Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise, objectionable material, transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice gaining unauthorised access to other computer systems, interfering with any other person’s use or enjoyment of the QUANACE websites, breaching any laws concerning the use of public telecommunications networks interfering or disrupting networks or websites connected to the QUANACE websites, making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction, and all settlements sums paid by us as a result of any settlement agreed by us arising out of:

Any claim by any third party that the use of the QUANACE websites by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;

Any claim by any third party that the use of the QUANACE website by you infringes that third party’s copyright or other intellectual property rights of whatever nature; and
any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the QUANACE websites by you.

10. Availability of the QUANACE websites

Although we aim to offer you the best service possible, we make no promise that the services at the QUANACE websites and offline will meet your requirements – we cannot guarantee that the service will be fault free. If a fault occurs in the service, you should report it to our Customer Care Team (see below for contact details) or by email, and we will attempt to correct the fault as soon as we reasonably can.

Your access to the QUANACE websites may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.

11. QUANACE Liability

The QUANACE websites are provided without any warranties or guarantees. You must bear the risks associated with the use of the Internet. While we always try to ensure that material included on the QUANACE websites is correct, reputable and of high quality, we cannot accept responsibility if this is not the case. We will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the QUANACE websites. If we are informed of any inaccuracies in the material on the websites, we will attempt to correct the inaccuracies as soon as we reasonably can. In particular, we disclaim all liabilities in connection with the following:

Incompatibility of the QUANACE websites with any of your equipment, software or telecommunications links, technical problems including errors or interruptions of the QUANACE websites, unsuitability, unreliability or inaccuracy of the QUANACE websites, inadequacy of the QUANACE websites to meet your requirements.

To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the QUANACE websites.

If any exclusion or other provision contained in these Terms and Conditions are held to be invalid for any reason, and we become liable for loss or damage that could otherwise have been limited, such liability shall be limited to £50.00 (Fifty Pounds).

Our acceptance of an order takes place on dispatch of the order, at which point the purchase contract will be made and you will be charged for your order.

12.   Third Parties

QUANACE is not responsible for content on the Internet or World Wide Web pages, of any third party site. We have no control over these parties. We hereby waive any claim you might make against us in respect of third party services, sites and their operators. You may order services or merchandise through links on our site from third parties, and purchase products sold by third parties. All matters concerning the merchandise or services, including but not limited to purchase terms, payment terms, warranties, guarantees, maintenance and delivery, are solely between you and the merchants with whom you chose to do business. We make no warranties or representations whatsoever concerning any goods or services provided by those merchants. You will not consider us – nor will we be construed as – a party to such transactions, whether or not we may have received some form of revenue or other remuneration in connection with the transaction or service. Nor will we be liable for any costs or damages arising from any transaction or service (whether directly or indirectly) between you and any other person or entity.

13. Advertising and Sponsorship

Part of the QUANACE websites may contain advertising and sponsorship. Advertisers and Sponsors are responsible for ensuring that material submitted for inclusion on the QUANACE websites complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material.

14. International Use

We make no promise that materials on the QUANACE websites are appropriate or available for use in locations outside the United Kingdom, and accessing the QUANACE websites from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

15. Expiry Date on Payment Card

Please ensure that the expiry date of your payment card is after the anticipated dispatch date of your order. Payment is taken at the point of dispatch for goods and if the payment card has expired, we will be unable to take payment and fulfil your order.

16. Miscellaneous

You may not assign, sub-licence or otherwise transfer any of your rights under these Terms and Conditions.

17. Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England.

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

If you breach these Terms and Conditions and we ignore this, we will still be entitled to use its rights and remedies later or in any other situation where you breach the Terms and Conditions.

We shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.

A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions.
